Under Trade Mark Act, 1999 trademark is covered a symbol, word, or phrase that identifies and distinguishes the goods or services of a particular company or individual from those of others. Trademarks can be registered with the Trademark Registry in India to give the owner exclusive rights to use the mark in connection with their products or services. In order to be eligible for registration, a trademark must be distinctive and not be similar to any existing trademarks in the same class of goods or services. Once registered, a trademark owner can take legal action against others who use the mark without permission.
